1. Valuation/Minerals: "In a condemnation action the
existence of mineral deposits in or on land is an element to be considered in
determining the land's value. Nevertheless, where the property is not taken for
the purpose of obtaining the minerals or as an ongoing business it is improper
to appraise the mineral deposits separately and add the mineral value to the value
of the land." Testimony should be restricted to the effect the presence of the
minerals would have on market value. State, Dep't of
